ECtHR awards almost 10,000 euros to Krasnodar resident for his extra stay in SIZO

The European Court of Human Rights (ECtHR) found that in 2008, Anatoly Ataev, a resident of Krasnodar, was unfoundedly left in SIZO (pre-trial prison) after a court had pronounced a decision to release him. The ECtHR obliged the Russian authorities to compensate the man for moral harm.

On August 5, 2008, in Krasnodar, the court pronounced a decision on the conditional early relief (CER) of Anatoly Ataev. However, the chief of the SIZO administration did not execute the court's decision and noted that the court's decision could be reviewed by the court of appeal and that Anatoly Ataev could hide during that time. As a result, the man was kept at the SIZO until October 8, 2008, in violation of the court's decision on his release, the "Mediazona" reported on May 17, 2016.

Today, the ECtHR has awarded 9750 euros in compensation for non-pecuniary damage to Anatoly Ataev. According to the ECtHR, the Russian authorities violated the complainant's rights, since the man was kept in unsatisfactory detention conditions at the SIZO and was not released after the court's decision on his CER, the press service of the ECtHR reported.

The story of Anatoly Ataev is not unique to the Krasnodar Territory, claims Sergey Romanov, the head of the Krasnodar branch of the "Committee Against Torture" (CaT). "We regularly encounter a situation in the region when there is a court's decision on release, but SIZO heads do not release people and wait for some papers, some documents with prints, and all that happens in the era of new technologies. And as a result, people have to spend in SIZO from several days to several weeks in wait to be released," Sergey Romanov told the "Caucasian Knot" correspondent.
