ECtHR found violation of rights of 14 Azerbaijani citizens during elections

The European Court of Human Rights (ECtHR) has upheld the complaint of 14 applicants from Azerbaijan about violation of their rights during the 2010 parliamentary elections and decided that the applicants should receive compensations from the Azerbaijani authorities in the amount of 135,000 euros.

On November 7, 2010, Azerbaijan held elections to the National Assembly. By the outcomes thereof, the ruling party "Yeni Azerbaijan" increased the number of its seats from 63 to 75.

The complaints asked to recognize violations of applicants' rights guaranteed by Article 3 (right to free elections) to Protocol No. 1 to the European Convention of Human Rights (ECHR), the advocate Asabali Mustafaev told the "Caucasian Knot" correspondent.

According to his story, the applicants, in particular, claimed unjustified refusal to register candidates for MPs, violations on the voting day and during the vote count, and the unlawful rejection of complaints by election commissions and courts.

The ECtHR has decided that compensation for moral harm of 12 applicants should make 10,000 euros each; two other applicants – Egyane Gadjieva and Khayam Mamedov, whose interests at the ECtHR were represented by Asabali Mustafaev – were awarded the compensation of 7,500 euros each.

Earlier, according to the advocate, "the ECtHR had granted some 5-6 claims related to 2010 parliamentary elections; and some 50-60 more complaints are pending."

Let us remind you that in October, the ECtHR found a violation of the rights of activist Annagi Gadjibeili during the 2010 parliamentary elections and awarded him compensation in the amount of 10,000 euros.
