In Dagestan, advocate of detained Seitekaev complains that he is not admitted to his client

Muslim Seitekaev, a resident of the Khasavyurt District of Dagestan, kept at IVS (temporary detention facility), is not allow to be visited by his defender. This was reported by Sapiyat Magomedova, the detainee's lawyer.

Muslim Seitekaev, the 23-year-old resident of the village of Botashyurt, was detained on August 14, 2011, and, since then, according to his relatives, they knew nothing about him.

"On the day of his detention, we participated in a funeral ceremony at our relatives' place. When we returned, we saw a cordon around the house of people in camouflage and military equipment vehicles Ural and armoured transport vehicle. As it turned out, they came to arrest my brother, who was at home," Arsen Seitekaev, an elder brother of the detainee, told the "Caucasian Knot" correspondent. "I was immediately given to understand that he was suspected either of assistance or direct involvement in illegal armed formations. At the time, when I returned from the funeral, they conducted a search in the house without witnesses, during which weapons a pistol and a submachine gun were found."

Arsen doubts that the weapons could belong to his brother. "I do not think that he can have relationships with 'forest people'," the detainee's brother says.

"If investigators filed a charge against him, let them give us to know the specific charges against him. If he is guilty of something, let them give him a fair trial," the detainee's brother said. "We demand that the investigatory authorities act within the law of the Russian Federation. And what we have at present: Muslim was detained six months ago, and till present, we did not know, where he was kept and what charges were filed against him. Why policemen are hiding him from his lawyer?"

According to the lawyer Sapiyat Magomedova, hired by the Muslim's relatives, she faced opposition from law enforcement bodies. "Getting started, I began to make official requests to the authorities to establish the Muslim's whereabouts; however, according to the answers received, the GOVD (Interior Division) of the Khasavyurt, the ROVDs (District Interior Divisions), and the SIZO (pre-trial prison) did not have him kept at their places," the lawyer said.

"We found Muslim by chance. I came to the Khasavyurt IVS, presented a warrant and asked to let me visit my client Seitekaev. At once, staff members of the IVS hesitated; they began to get nervous and said that Muslim was taken for questioning by Usman Amaev, the investigator. So, by chance, after 6 months of lack of information, we found the man," Sapiyat Magomedova stated.

She said that later she appealed to the Investigatory Committee of Khasavyurt, the investigator Usman Amaev. "I came in and said that I was the Muslim's lawyer and that I was hired by his relatives, and I asked, starting from that day, to conduct all investigatory actions with my participation and to inform me about them. However, the investigator said that he did not know, who I was and who hired me, and that Muslim would reject my services in half an hour," the lawyer said.

According Sapiyat Magomedova, the investigator did not give her to familiarize with the case and refused to inform her of charges filed against her client. "They should have informed the relatives at their request about the charges filed against Muslim; however, the investigator refused to inform even me the lawfully hired lawyer about the charges against him. They cannot keep the man in custody for six months without filing charges against him."

According to the lawyer, through her sources she found out that Muslim had been charged under Article 222 of the Criminal Code of the Russian Federation (illegal possession of weapons) and Article 295 of the Criminal Code of the Russian Federation (attempt on life of a person administering justice or preliminary investigation).

Sapiyat Magomedova has filed complaints against the actions of the Investigatory Committee under the Prosecutor's Office of the Khasavyurt District to the Prosecutor's Office, the Department for Inherent Security, the President of the Russian Federation, and the leader of Dagestan.

In his turn, the investigator Usman Amaev, who deals with the case against Muslim Seitekaev, told the "Caucasian Knot" correspondent that the detainee had a state lawyer and that he had refused the services of the other lawyer.

"I am not obliged to inform anyone about charges filed against M. Seitekaev. Should he have been not guilty, we would not keep him for six months in custody," Usman Amaev stated.

The investigator refused to name crimes, of which M. Seitekaev was suspected. "I do not remember all articles of the Criminal Code. And why should I tell you something?" he told the "Caucasian Knot" correspondent.
