Sergey Klimuk convicted of exploding Cherkizovo marketplace files complaint to Constitutional Court

Sergey Klimuk, a former FSB agent, serving a sentence for organizing an explosion at Cherkizovo marketplace in 2008, who was sentenced to life imprisonment, requests to declare unconstitutional the provision of law prohibiting an appeal against a guilty verdict of the jury court.

This was reported by Dmitry Agranovsky, a convict's lawyer, to the "Caucasian Knot" correspondent.

"People, who have chosen a jury court as a form of judicial procedure, actually lose their cassation and supervisory appeal opportunities, and this contradicts Article 19 of the Constitution of the Russian Federation, which prohibits discrimination, and Paragraph 3 of Article 50 of the Constitution, which states that everyone has a right to revision of sentence by appealing," the lawyer said.

Dmitry Agranovsky also clarified that the European Convention on Human Rights also provided appropriate provisions. "In April we filed an appropriate complaint to the European Court of Human Rights," he said.

On August 21, 2006, 14 people, including two children, were killed in the explosion at Cherkizovo marketplace. 55 visitors and market employees were injured. On April 30, 2008, the jury pronounced a verdict of guilty to the defendants. On May 15, 2008, the Moscow City Court pronounced sentence of imprisonment for terms from two years to life imprisonment to eight defendants.
