Court in Dagestan upholds prosecutor's refusal on Bammatova's complaint

Advocate Gulnara Bammatova intends to insist on initiation of a criminal case against the employee of the Dagestani Drug Control Department, who, according to her story, caused bodily injuries to her. This was stated by advocate Konstantin Mudunov who defends Ms Bammatova. On February 17 he received a statement of the Sovietskiy District Court of Makhachkala who sat on February 11 and confirmed the refusal of the prosecutor's office to reject the criminal case.

Konstantin Mudunov has confirmed on February 17 he received the statement of the Sovietskiy District Court of Makhachkala on refusal to initiate criminal proceedings against Omarov. The court session presided by Judge Magomedova was held on February 11; however, Mudunov received a copy of the statement only on February 17. After getting acquainted with this package, the advocate plans to address the General Prosecutor's Office of Russia, since, according to his story, the case has been closed in Dagestan.

According to Gulnara Bammatova, her health condition leaves much to be desired - she is still suffering from headaches. She said that immediately after the incident she filed a petition to the prosecutor's office of the Sovietskiy District of Makhachkala.

"Initially, the case was run by inspector Issa Buragin. However, under the pretext that he has plenty of work, so far, he has ignored my application. Now, inspector Murtuz Abdullabekov is in charge; however, everything remains the same: they just create appearance that the prosecutor's office is dealing with my complaint. They send summons to me dated last November, although envelopes are stamped as January and February this year. The data of the computer tomography, which I underwent immediately after hospitalization, disappeared from the case files; there's also no video materials from the day, when it all happened," Bammatova told the "Caucasian Knot" correspondent.

Konstantin Mudunov has stated that he received the materials from the prosecutor's office about refusal to initiate the criminal case four months after he filed his advocate's request.

He said that the investigator questioned 15 witnesses; all of them are employees of the Drug Control Department. "Of course, while defending their 'esprit de corps', they all give identical evidences: nobody had ever touched my client with a finger. It was she, they say, who initiated a scandal, attacked the ensign, and then fell and hit her head. Ensign Magomed Omarov, who raised his hand on the woman, escaped punishment. It turns out that his actions were acquitted. The guilty was the one who issued a pass to advocate Bammatova," said Konstantin Mudunov.

When asked by the "Caucasian Knot" correspondent whether he and his client would insist on a criminal case, Konstantin Mudunov answered in the affirmative, despite the fact that, according to his story, the opposing party had attempted to conclude an amicable agreement.

"In recent time, our power agents made it a habit to beat women-advocates. They receive bodily injuries, and then they are themselves accused of all mortal sins," said Mudunov.

According to his story, earlier Shavlukov, deputy head of the division of own security of the Drug Control Department, wrote in his letter to Aguzov, President of the Bar Association of the Republic of Dagestan, that all the materials of the prosecutor's check had been collected and forwarded to the Investigatory Department for Dagestan of the ICRF (Investigatory Committee of the Russian Federation) "for giving a legal assessment to Bammatova's actions." These actions, according to Shavlukov, were manifested by "public insult of a law enforcement officer while performing his official duties and publication in media of knowingly false information, defaming his honour and dignity."

The "Caucasian Knot" correspondent tried to contact Shavlukov himself, but the duty officer at the Department, who named himself as Magomed Magomedovich Magomedov, when hearing the subject of correspondent's request, said that his boss was not there, while the incident with "that female-advocate should have been forgotten long ago." "And anyway, she was to blame for all that. Our people were doing their job and acted under the regulations," said the on duty officer.

The correspondent also could not contact Murtuz Abdullabekov, the inspector of the prosecutor's office, who runs the case of Gulnara Bammatova. After repeated direct calls, he was given all the telephone numbers for contact, but as reported by a certain Elvira, an assistant of the inspector of the prosecutor's office, the above Murtuz had ignored the note with telephone numbers.
