Inspectors break the rights of Daurbekov, suspected of Vladikavkaz terror act, advocate asserts

Khizar Daurbekov, a suspect of complicity in the explosion on September 9 in the marketplace of Vladikavkaz, where several dozens were lost, is still kept in the SIZO (pre-trial prison) of Vladikavkaz. His relatives and defender insist on his complete innocence and state gross violations of his rights in the course of investigatory actions.

Khizar Daurbekov, a resident of the Ingush village of Yandare, was detained on October 27. This event was preceded by an explosion that occurred on October 8 at about 6 in the morning inside the Daurbekovs' household at: No. 80 Akhrieva Street. According to Medan, Daurbekov's mother, it was just after the explosion that anonymous agents of unidentified power structures began to appear in their house. Besides, the family was exposed to several searches; while the damage caused to the house by the explosion was not compensated by local authorities.

The mother connects the explosion and subsequent arrest of her son as an accomplice in the terror act with the pressure on their family and does not exclude that the cause of persecutions is in religious beliefs. Before the arrest, Khizar was a pupil of the local Imam and an active believer.

Magomed Tsitskiev, an employee of the office of the Ombudsman in Ingushetia, told the "Caucasian Knot" correspondent that he received an application from Daurbekov's mother on October 29.

"We started a check and forwarded respective requests to instances. As a result, we received information that he was detained and sent to the IVS (temporary detention facility) of the MIA of North Ossetia. However, until November 17, that is, within three weeks, an advocate was not admitted to him; while under the law, an advocate should be present from the moment of detention. In the end, through cooperation with the Ombudsman in North Ossetia, the detainee could see his advocate," said Tsitskiev.

Besides, according to the Ombudsman, they summed up the information on violations of Daurbekov's human rights during his detention and investigatory actions. "In particular, we reported that inspectors violated Article 96 of the Code of Criminal Procedure (notification of relatives about detention of a suspect within 12 hours). Daurbekov's relatives did not know where he was for two days. At the moment, we are waiting for the reaction of the General Prosecutor's Office so that to bring the guilty persons to responsibility," said the Ombudsman in Ingushetia.

Mr Tsitskiev did not rule out that the suspect might have been pressed by inspectors; however, this was not established officially.

"The complaint of Daurbekov's advocate is not the single case of claims against inspector Chaptsev. Defenders of those detained earlier on the same case (Explosion Case No. 12/2474) about the explosion triggered on September 9 in Vladikavkaz, including Islam Khashagulgov, also complained of this inspector," said Tsitskiev.

At the trial on the complaint against the refusal to meet an advocate, which was considered by the Lenin District Court of Vladikavkaz, Alexander Chaptsev explained that the detainee Daurbekov himself refused to meet his advocate Gagiev and even wrote an official application that he did it voluntarily.

Magomed Gagiev, detainee's advocate, managed to insist on Daurbekov's delivery to the court. At the trial, according to Gagiev, Daurbekov confirmed that he had written the waiver of advocate under pressure and threats. As a result, his meetings with the advocate were permitted in the judicial order.

At the same time, so far, relatives were unable to visit the detainee. According to Daurbekov's mother, she is concerned about it and has no firm confidence that the physical and psychological condition of her son is satisfactory.
