The penal clause for the native of Chechnya accused of murder of Volkov has been changed

A more severe charge against Ahmedpashi Aidayev, native of Chechnya, the main suspect of the murder of football fan Yury Volkov has been brought, Abusupyan Gaitayev, the defendant's attorney, reported on October, 11.

"Now instead of part 1 clause 105 (murder) he is being accused according to point "i" part 2 clause 105 (murder from rowdy motives) of the Criminal code of the Russian Federation, "Interfax" quotes the attorney's words.

Abusupyan Gaitayev, the defendants' attorney, thinks that requalification of the accusation is advantageous for Aidayev, his client, for now his case will be heard at the trial by jury, GZT.ru reports. 

According to the Criminal code, a crime upon part 1 clause 105 (murder) inflicts a penalty in form of imprisonment for a term of six to fifteen years and a crime upon part 2 clause 105 (murder from rowdy motives) inflicts eight to twenty years or a lifelong custodial sentence. 

"Caucasian Knot" has formerly reported that the term of arrest of Aidayev accused of the murder of Volkov was prolonged by the judgment up to December, 10. The investigators explain the prolongation of the term by carrying out psychological and psychiatric expertise and other investigative actions.

Ahmedpashi Aidayev and Bekhan Ibrahimov, figurants of the case, deny all the accusations brought against them and state that the scuffle has been provoked by the football fans.
