Relatives of the "Caucasian Knot" correspondent who perished in road accident and doctors disagree with the investigation

Based on the data of the investigation, in the context of causing heavy harm to human health that entailed death of Bella Ksalova, a "Caucasian Knot" correspondent, the Investigatory Committee at the Prosecutor's Office of the Karachai-Circassian Republic (KChR) made a decision to open a criminal case against the driver Arsen Abaikhanov who knocked her down. In the next few days his freedom restriction measure will be chosen.

"The inspector will start gathering materials anew," said Fatima Kardanova, head of the press service of the Ministry of Internal Affairs (MIA) of the KChR. "The driver and all the witnesses of the road accident will be interrogated again."

The press service assumes that the investigation of the road accident will take long. The "Caucasian Knot" is tracing the situation and plans to report the course of the investigation of the accident, which had entailed Bella Ksalova's death.

Boris Ksalov, Bella's father: I talked to every witness of the road accident

Right after the tragedy, the MIA of the KChR hurried to state that the driver was not guilty: he was not drunk and did not exceed the speed limit, while Bella crossed the road in a wrong place. Her father - Boris Fyodorovich Ksalov - was not happy with the inquirer's work. "On the following morning after the accident," he said, "my son went to the venue and found Bella's keys, slippers and a hairpin. The things were in different places. How had militiamen examined the place of the incident, if my son found so many Bella's belongings?!"

While in doubt of the efficiency of the inquiry conducted by law enforcers, Boris Ksalov conducted his personal investigation of the tragedy: "I met everyone who was the witness of the road accident. There are people among them asserting that the Volga passenger car that had brought down Bella was driven by a drunken woman, but they wouldn't say it for the protocol - people are intimidated. They say: 'And if the same happens with us tomorrow?'."

At the moment of the tragedy, apart from Abaikhanov, there were five more persons in the car: two men, two women and an 18-month-old child. The driver was the only one non-drunken at the moment; therefore, he takes the responsibility, Bella's father is sure.

Boris Ksalov categorically disagrees with the official conclusion that the speed of the car at the moment of the accident was below 60 km/h. "Bella's weight was 66 kg; the blow was so strong that the motor hood fell down on the engine. It's possible only at high speed," he says.

Making comments on the statement of the MIA of the KChR that Bella "crossed the road in a wrong place," Boris said that that his daughter was knocked down ten meters off the pedestrian crossing, practically near the roadside, and the blow was so strong that the girl was thrown onto the roof of the car. After the collision, the car still drove some 300 meters further, and only then - by back running - approached the place where Bella was lying.

Doctors' evidences indirectly confirm relatives' opinion

Doctors of the Republic's Hospital, where Bella was brought after the accident, also indirectly confirmed Boris Ksalov's findings: "The girl had numerous traumas of internal organs, a craniocerebral trauma and great loss of blood. Her traumas were incompatible with life."

For three hours surgeons tried to save Bella Ksalova, but she died on the surgeon's table. The reasons, which entailed her death, were a liver break, a tear-off of the kidneys, a pelvic fracture, a great blood loss and a craniocerebral trauma. "At the car speed of 60 km/h such heavy traumas are impossible," one of the doctors, who fought for Bella's life, asserts.

Arsen Abaikhanov: murder is a huge sin for me

Arsen Abaikhanov, the driver of the car, which killed Bella, is 27. He categorically insists that he was driving the car at the moment of the accident.

"It's an abrupt descent there; the road is not illuminated. A car with xenon and anti-fog headlights on moved from the opposite direction and blinded me for some seconds. I dropped the speed and saw a dark silhouette right in front of my car. In the next instant a blow took place," the driver says.

He asserts that he at once stopped the car, went out and immediately called the first aid: "Having come closer I saw a girl down without consciousness. I fell down beside her and kept saying one phrase like an incantation: "You just hold out, everything will be OK."

After Bella was taken away to hospital, Abaikhanov, according to his story, called his brother and a close friend, asked them to take money and go to the hospital to learn about Bella's condition. "They called me every 15 minutes. I prayed asking the God to save her. One of the doctors, who took part in the surgery, came out to relatives and said that Bella would survive. And 20 minutes later they called me and said that the girl died," said the driver.

How should I live on with this? Any driver will understand me.

"For me a murder is a very great sin. The biggest sin," says Abaikhanov. "I asked militiamen: 'How should I live on with this?' Any driver will understand me. I'm a man, but I couldn't stop tears, and they calmed me: 'You aren't guilty. Don't tear your heart; this can happen with anyone'."
