Court sides with Chechen convict in dispute with colony administration

The appellate instance has not satisfied the complaint of the colony administration against the decision of the Grozny court, which found rights violations of Arbi Dandaev, a native of Chechnya, who was convicted within the case of the attack of Basaev's militants on Dagestan.

The "Caucasian Knot" has reported that in March 2009, the Supreme Court (SC) of Dagestan sentenced Arbi Dandaev to life imprisonment, concluding that during the militant attack on Dagestan in 1999, he personally took part in executing six militaries. The Russia's SC found the verdict as legal.

On August 7, 1999, more than a thousand armed militants led by Shamil Basaev and Amir Khattab (also referred to as Emir Khattab), a Jordanian, entered Dagestan from Chechnya. The fighting continued for more than a month; only on September 15, 1999, Igor Sergeev, the Russian Defence Minister announced that Dagestan had been completely liberated from the attackers.

The Chechen SC has upheld the ruling of the Visaitovsky District Court of Grozny dated June 28, 2022, which partially satisfied Arbi Dandaev's claim against the penal colony in the Khabarovsk Territory. Dandaev demanded that the actions of the administration be declared illegal and that he be compensated for violating the custody conditions. In particular, the Constitution and the Chechen-Russian dictionary were seized away from him; electricity was turned off during the fasting month of Ramadan; and his possibility to watch TV was limited.

Dandaev demanded compensation of 500,000 roubles. The district court has ordered the colony administration to pay him 10,000 roubles and rejected all his other claims.
