Court refuses to compensate relatives of those who perished during second Chechen military campaign

The Supreme Court of Chechnya refused to grant the claim for payment of compensation for moral damage to relatives of policemen Aslanbek Kukaev and Roslanbek Damaev, who perished during the “mopping-up” operation in Grozny.

The “Caucasian Knot” has reported that the European Court of Human Rights (ECtHR) recognized the guilt of the Russian authorities in the killing of Aslanbek Kukaev, a policeman from Grozny, and awarded his family compensation of 42,000 euros.

On November 26, 2000, Aslanbek Kukaev, together with his colleague Roslanbek Damaev, went to work in the area of the Central Market of Grozny. On that day, the federal troops were conducting out a “special operation” there and detained Aslanbek Kukaev and Roslanbek Damaev. On the same day, all the detained Chechen policemen returned home, except for Aslanbek Kukaev and his colleague. Their bodies were found four months later.

The Supreme Court (SC) of Chechnya has deprived the families of Aslanbek Kukaev and Roslanbek Damaev, who were killed by the militaries, from the compensation they had been awarded. In 2019, in Grozny, the court ruled to pay a million roubles to each of three relatives as compensation for non-pecuniary damage, the “Kavkaz.Realii”* reports.

On June 28, 2022, the court considered the claim of the Russian Ministry of Finance and refused to pay compensation to the families of the perished policemen.

The “Caucasian Knot” has also reported that the Supreme Court of Chechnya cancelled the court’s decision on the lawsuit of the Russian Ministry of Finance, which challenged the award of compensation amounting to 400,000 roubles to Chechen resident Shamsold Akhyadov for being wounded during the second Chechen military campaign.
