Court dismisses complaint about search of house of Rakhim Veliev, activist of "Nida" movement
An advocate has demanded to recognize illegal a search carried out without a court order in the house of Rakhim Veliev, an activist of the Azerbaijani movement "Nida", during which a mobile phone and a PC were seized. The defence intends to challenge the court's decision.
The "Caucasian Knot" has reported that on January 16, Rakhim Veliev was detained, and his house was searched. The court has sentenced the activist to 30 days of administrative arrest under the article of disobeying the police. On January 21, advocate Elchin Sadygov disseminated the complaint of Rakhim Veliev about beating and abuse by the police.
Rakhim Veliev openly criticized the authorities of Azerbaijan. Shortly before his arrest, he wrote a post on the Facebook, in which he condemned prosecution of his friends. Activists of the movement "Nida" treat the above fact as the real reason for the arrest of Rakhim Veliev.
Today, the Narimanov District Court of Baku has considered the complaint filed by the advocate of Rakhim Veliev.
"Unfortunately, Judge Samir Mamedov refused to take into account our arguments and dismissed the complaint, although violations are obvious," noted advocate Elchin Sadygov.
According to the advocate, the defence intends to appeal to the European Court of Human Rights (ECtHR) and raise questions of violation of the Rakhim Veliev's rights, guaranteed by Article 3 (prohibition of torture), Article 5 (right to liberty and security), and Article 6 (right to a fair trial) of the European Convention on Human Rights.
