Complaint of Eskerkhanov's defence about the order of charging rejected

The Moscow City Court (MCC) has upheld the order of indicting Tamerlan Eskerkhanov, a figurant in Boris Nemtsov's murder case.

According to Eskerkhanov's defence, the investigator had failed to inform the defendant duly – via the administration of the SIZO (pre-trial prison) – about the day of indicting.

Earlier, a similar complaint of the defence was rejected by the Basmanny Court. The advocates asked to recognize the investigator's actions as illegal and eliminate the violations. "My client was not duly notified and was not able to exercise his right to defence," the RIA "Novosti" has quoted the advocate Olga Golub as saying today.

According to Eskerkhanov himself, he was not notified about the procedure of indicting.

The investigator told at the court session that the order of notification was not violated. The prosecutor supported this position and noted that the administration of the SIZO, where Eskerkhanov was kept, was notified about the procedure of presenting the charge.
