Kislovodsk Imam repeatedly refused in initiating criminal proceedings against FSB agent

The investigating authorities have repeatedly refused to open a criminal case against an agent of the Russian FSB for the StavropolTerritory under the complaint filed by Kurman-Ali Baichorov, the Imam of Kislovodsk. According to the defender of the Imam, who is accused of drug trafficking, the FSB agent exceeded his power, used violence and falsified evidence.

The "Caucasian Knot" has reported that on October 29, 2013, Imam Kislovodsk Kurman-Ali (Kurman) Baichorov was accused of illegal possession of narcotic drugs. According to investigators, on October 17, 2013, inspectors of the road police (known as GIBDD) stopped his car, searched him and found a package with the drug. Kurman-Ali Baichorov pleads not guilty.

On October 22, Kurman-Ali Baichorov declared a hunger strike and claimed the Court violated his right to defence. His supporters associate criminal proceedings against the Imam with his rigid position concerning mosques in Kislovodsk, where the authorities banned their construction.

The Imam has filed a complaint against being prosecuted by the FSB agent, and on October 23, the court sent the materials in respect of the FSB agent to the Investigating Committee of the Russian Federation (ICRF) for inspection. On October 28, the defence of Kurman-Ali Baichorov received the resolution with the refusal to initiate criminal proceedings against the FSB agent.

The resolution on the repeated refusal was issued on November 7. However, it was not received by the defence of Kurman-Ali Baichorov until November 11. This was reported by advocate Alaudi Musaev, who called the decision of the investigating body "groundless."

According to the advocate, the re-inspection carried out by the decision of the Prosecutors' Office was superficial and failed to give answers to the questions raised by the defence in the complaint filed.

"We will complain till the end of time, until they show respect for the law," Alaudi Musaev has said.
