Tenants of a multistory in Sochi complain of violation of their rights by construction of a roadway

During a gathering on May, 14, tenants of house No 2, 20th Gornostrelkovaya division street, declared violations of their right for safe dwelling by the constructors of a roadway.

About 50 local residents participated in the gathering. Representatives of the community committee informed that in 2008 the committee received a land management certificate confirming the right of the owners on the premises, the land under the house and house land plots. "The whole our territory occupies 2600 square meters", members of the community committee declared. The residents devoted themselves to improvement and landscaping, planted bushes and flowers.

"In 2011 Governor of Krasnodar region Alexander Tkachev issued an order No 313-r which in fact confiscated the whole of our territory for construction of an Olympic object, i.e. the roadway between 20th Gornostrelkovaya division street and Transportnaya street up to the stadium", the residents informed. Now they are fearing for integrity of their house.

Noise from "KamAZ" and "MAZ" trucks, tractors and concrete mixers is getting into the windows round the clock. Building dust is amassing in the flats. We are just dying. The multistory where about three hundred people, from babies up to old folk, live became unfit for dwelling", Evdokia Balakina complains.

The roadway is being built in half a meter distance from the house. The construction is carried out in the territory of the house land plots. There are no sidewalks and according to the tenants, they are even afraid to come out of the house out of danger of getting under construction site engines.

Member of community committee Nina Khalvash emphasized the absence of municipal control of the activities of construction companies. According to her, oils are dumped into the Bzuza river flowing near the house, cement and concrete also get there. Khalvash states that the river falling into the sea in the area of beaches has turned into a cesspit.

Representatives of Press service of Sochi Administration informed that the customer of construction in the territory of house No 2, 20th Gornostrelkovaya division street was the Department of highways of Krasnodar region. The general designer in "Mostovik" research and manufacturing association, the subcontractor is "Mostotoneldorstroy" limited corporation. According to a representative of Press service it is planned to put the roadway in commission by May, 31, 2012.

Sergey Yurchenko, First Deputy Head of Olympic department of Krasnodar region explained that according to Federal Law No 310, Decree of the Ministry of Regional Development of the Russian Federation No 66 dated September, 7, 2010, and layout documentation on construction of the roadway in 20th Gornostrelkovaya division street, servitude on the house land plots on house No 2 was enacted for the construction period (servitude is a limited right of use of another's land parcel, for example, for passage, laying and exploiting the necessary communications or other needs that cannot be provided for without enacting servitude - note by the "Caucasian Knot").
