Court finds refusal to initiate case on injury of Dagestan resident during special operation illegal

On December 17, the Khasavyurt City Court of Dagestan, presided by Federal Judge Akif Gadzhiev, considered and satisfied the complaint lodged by Gasan Baisultanov, a resident of Khasavyurt.

The applicant asked to recognize illegal the statement of Senior Inspector of the Prosecutor's Office of Khasavyurt Arslan Arslankhanov dated December 9, 2006, on refusal to initiate a criminal case on the fact of murdering his pregnant wife Saniyat Magomedova and giving a heavy wound to himself by the employees of the Kazbek ROVD (District Militia Unit) in the course of special operation conducted on November 3, 2006.

Having listened to arguments of Baisultanov, his advocate and evidences of the witnesses, Judge Gadzhiev has made a decision: Arslankhanov's statement on refusal to initiate a criminal case on the fact of Saniyat Magomedova's murder was illegal. Baisultanov's advocate has stated that justice should triumph, and innocent persons should be acquitted.
