Movlaev's defense called the extension of the extradition detention unlawful.

The law provides for no more than 12 months of extradition detention; there are no grounds for its extension for the native of Chechnya, Mansur Movlaev, the defense indicated in an appeal to the Attorney General of Kazakhstan, asking him to verify the legality of the decision to extend the detention period. The lawyers were not even allowed to attend the hearing.

Movlaev's defense indicated that according to part 9 of article 589 of the Criminal Procedure Code of the Republic of Kazakhstan, after the expiration of the twelve-month period of extradition detention, its extension is allowed only in two cases: if additional time is needed to organize the transfer of the extradited person to the requesting state; or to consider the complaint of the extradited person against the decision of the Attorney General of the Republic of Kazakhstan or his deputy regarding extradition. "Currently, none of the grounds specified by law are present," the appeal states.

The lawyers noted that the transfer of Mansur Movlaev is impossible, "since the execution of the extradition decision is suspended until the national asylum procedures are completed, as well as due to the interim measures applied by the UN Human Rights Committee regarding communication No. 4877/2026, which suggested that the Republic of Kazakhstan refrain from extradition until the case is considered on the merits." "Despite this, Mansur Movlaev's extradition detention was first extended to 14 months, and then to 20 months. Thus, further detention of Mansur Movlaev is carried out outside the grounds directly provided for by part 9 of article 589 of the Criminal Procedure Code of the Republic of Kazakhstan." "In the absence of the grounds provided by law, take measures to eliminate the violation of the law and release Mansur Movlaev from extradition detention," the conclusion states.

Lawyer Murad Adam, who was previously one of Movlaev's lawyers, reported on his Instagram* page that "no lawyer was involved in the court process" regarding the extension of the preventive measure. "The powers of the defenders were submitted to the case materials, but the court still held the hearing only with the participation of the prosecutor, and of course, the secretary. Unfortunately, we have hit rock bottom in terms of legality and the rule of law," he stated.

Recall that Mansur Movlaev was detained by security forces in Chechnya in 2022 and was held in an illegal prison. He escaped from there in January 2023 and made it to Kyrgyzstan. In August 2023, security forces in Kyrgyzstan detained Movlaev, who was wanted in Russia on charges of financing extremism. The court in Bishkek sentenced Movlaev to six months in a penal colony and subsequent expulsion from the country. On November 20, 2023, Movlaev was released and left Kyrgyzstan on his own to avoid being sent back home.

In May 2025, Movlaev was detained in Kazakhstan and placed under extradition detention; the Attorney General's Office of Kazakhstan ruled to extradite him to Russian security forces. In February, the Supreme Court of Kazakhstan suspended the execution of the decision to extradite Movlaev until his asylum application is finally considered.
