A Sochi court has refused to overturn a land deal despite allegations of violations.

The court dismissed Sochi resident Alexander Batalin's claim to invalidate the sale of a neighboring garden plot to a woman seeking to build a road through Batalin's property. The judge disregarded arguments that the neighboring plot had previously been sold under a power of attorney from the deceased owner.

As reported by "Caucasian Knot," on April 3, the cassation court overturned the decision in the case concerning a disputed land plot in the Sochi gardening association "Kommunalnik" and remanded the case to the Khostinsky District Court for a new trial.

On June 5, Alexander Batalin received a decision from the Khostinsky District Court of Sochi, which refused to invalidate the transactions involving Nina Kuznetsova's land.

According to the text of the court decision of May 21, a copy of which is in the possession of the "Caucasian Knot," Batalin insisted in court that he only learned of Fotina's death in 2016. He argued that the transactions were void from the outset, and the statute of limitations should be calculated from the moment the transaction was discovered to have been concluded under a power of attorney from the deceased owner.

However, the defendants filed a motion demanding that the case be dismissed. Dubovsky, the defendants' representative, stated that Batalin "should have known" about the change in ownership of the neighboring property back in 2008, meaning he had missed the statute of limitations for filing his claim.

Judge Grigory Leoshik agreed with the defendants' arguments. "When it is established that the statute of limitations has been missed without good cause... the judge decides to dismiss the claim without examining other factual circumstances in the case," the court's ruling stated.

The court emphasized that more than 10 years had passed since the first questionable transaction, and Batalin himself knew back in 2016 that the property had new owners. The court did not consider the fact that the transaction was executed under a power of attorney from a deceased person.

A power of attorney terminates upon the death of a citizen, "but Sochi apparently has its own laws," commented lawyer Ramil Latypov, representing Batalin's interests, on the court's decision.

"For Alexander Batalin, this loss is not just a legal setback, but the threat of losing his own land. The fact is that the current owner of plot No. 35, Nina Kuznetsova, has waged a large-scale legal battle against her neighbor. She has previously filed seven lawsuits against Batalin, which were dismissed by the court, but currently, the Khostinsky Court is handling case No. 2-2717/2024. "Kuznetsova is demanding that a road to her plot be built through Batalin's land," Latypov told a "Caucasian Knot" correspondent, noting that the decision will be appealed in the Krasnodar Regional Court.

Alexander Batalin himself fears that he will ultimately lose his plot No. 34 due to demands for a road through it. "They are aiming to deprive me of my land," he shared his concerns with a "Caucasian Knot" correspondent.

"Caucasian Knot" has no comment from Nina Kuznetsova or her representatives at this time.
