The sentence against a Nalchik developer in the case involving apartments for orphans has been upheld.

The Cassation Court refused to overturn the sentence of Radzhab Aykham Kamal, a Syrian displaced person and the general director of Nedvizhimost-Nalchik LLC. In his testimony, he stated that he was unable to complete the construction of housing for orphans due to the sharp rise in prices for building materials following the imposition of sanctions after the start of the Second World War.

As reported by "Kavkazsky Uzel," on November 21, 2025, the Supreme Court of Kabardino-Balkaria increased the developer's sentence, replacing his suspended sentence with two years and ten months in prison for embezzlement of nearly 50 million rubles. the convicted man was taken into custody in the courtroom.

The director of Nedvizhimost-Nalchik LLC was charged with large-scale fraud. According to investigators, the accused entered into 45 government contracts with the Kabardino-Balkarian Ministry of Education in March 2022. These contracts required him to provide the agency with comfortable housing for orphans by December 15, 2022. The total value of the contracts was 55 million rubles. He received an advance payment of 49 million rubles, which he spent at his own discretion.

Developer Rajab Aykham Kamal, head of Nedvizhimost-Nalchik LLC, appealed the verdict of the Supreme Court of the Kabardino-Balkarian Republic to the Fifth Cassation Court. There, the verdict was upheld.

In the cassation appeal, the defense cited mitigating circumstances, the developer's admission of guilt, and the fact that Rajab Ai has two minor children, suffers from a serious illness, and is disabled.

The developer himself refused to testify in court. Earlier, during the preliminary investigation, he explained why he was unable to build the housing within the established deadline. He cited sanctions imposed in connection with the start of the SVO in 2022, the resulting increase in the price of building materials, and a labor shortage, which slowed the construction process. Documents were presented to the court: what materials were purchased and where the funds received under the contracts were spent. Witnesses confirmed in court that they received money for the building materials and delivered them. However, the investigation also revealed evidence of misuse of funds received from contracts by the developer.

Kabardino-Balkaria authorities promised to provide housing for 180 orphans

Funding for housing costs for orphans and children left without parental care in Kabardino-Balkaria has been increased from 200 million to 442 million rubles.

The customer, the Ministry of Education and Science of the Kabardino-Balkarian Republic, initially transferred 30 percent of the contract value, but later increased the amount to 90 percent. At present, the Arbitration Court of the Kabardino-Balkarian Republic is considering a claim filed by the Ministry of Education and Science against OOO SZ Nur for approximately 10 million rubles.

According to open sources, the consolidated list of orphans in Kabardino-Balkaria eligible for housing includes approximately 1,500 people, many of whom have been waiting for an apartment for ten years or more.

According to official sources in the Kabardino-Balkarian Republic, funding for the housing program for orphans has more than doubled, from 200 million to 442 million rubles. Court decisions to provide housing to orphans in Kabardino-Balkaria are not being enforced, and the amount of the certificate is insufficient to purchase an apartment, according to orphans who have been on the waiting list for over 10 years. One of those on the waiting list won a court ruling for rent compensation, but the republic's Ministry of Education filed an appeal.
