ECtHR awards compensation to relatives of Dagestani natives killed in Chechnya

The European Court of Human Rights (ECtHR) recognized the law enforcers’ responsibility for the deaths of eight residents of Dagestan in Chechnya in October 2016 and awarded 27 complainants 609,000 euros in compensation.

The “Caucasian Knot” has reported that on March 10, the Supreme Court (SC) of Chechnya found the killed natives of Dagestan guilty of an attempt on law enforcers and illegal arms trafficking, but closed the criminal case because of their deaths. In June 2020, the ECtHR communicated the complaint in the case.

On September 28, 2016, residents of Dagestan Gashim Uzdanov, Pakhrudin Makhaev, Islam Magomedov, and Shamil Djamalutdinov disappeared on the way from Kaspiysk to Makhachkala. On October 4, 2016, Gusein Guseinov, Klych Klychev, Shamil Djamalutdinov, and Kamil Djamaludinov disappeared in Khasavyurt. The law enforcers claimed that the above-mentioned Dagestani natives were plotting a terror act and were killed in a shootout. According to the law enforcers’ version, on October 9, 2016, the police tried to stop two cars in the Gudermes District of Chechnya. In response, the policemen were shelled from the cars. Eight suspected militants were killed and four policemen were wounded in the shootout, the Chechen Ministry of Internal Affairs (MIA) reported.

Advocate Pavel Chikov reported on his Telegram channel that according to the ECtHR’s decision, the investigation was launched with a significant delay, the law enforcers who opened fire on the dead were not identified, their total number was not determined, and they were not questioned. The exact cause of the deaths of the Dagestani natives is still unknown.

The “Caucasian Knot” has also reported that in November 2021, the Supreme Court (SC) of Russia found gross violations during the consideration of the cases against the residents of Dagestan killed in Chechnya. Relatives of the killed men demand to consider the case outside of Chechnya.

According to a mother of killed Kamil Djamalutdinov, neither the defenders nor the relatives of the accused believe that a fair trial is possible in Chechnya, where the natives of Dagestan were shot dead.
