Azerbaijani SC accepts Elchin Mamed's complaint

Elchin Mamed, a journalist and human rights defender, convicted within the case of theft and illegal weapon possession, insists on an acquittal. The Supreme Court (SC) of Azerbaijan has accepted his cassation complaint for consideration.

The "Caucasian Knot" has reported that on October 16, 2020, the court sentenced Elchin Mamed to four years in prison within the case of theft and illegal weapon possession. He refused to plead guilty.

Fariz Namazly, a Mamed's advocate, said that on April 30 he received a notice about the acceptance of the case to consideration by the court chaired by Aziz Seidov. The date of consideration of the complaint will be defined one of these days, the advocate told the "Caucasian Knot" correspondent.

According to the advocate, the defence raises in the cassation complaint the issue of the "illegality" of the appellate court's judgement.

"According to the country's legislation, the commission of a crime should be judged exclusively based on proofs, not of assumptions. The defence believes that the appellate court's judgement, like that of the first-instance court, is based on investigators' subjective conclusions, which are not supported by reliable proofs," Mr Namazly has stated.
