Court leaves Magamadov and Isaev in custody

Today, the Supreme Court of Chechnya has refused to grant an appeal filed by the defence against the decision to arrest Salekh Magamadov and Ismail Isaev. Advocates from the “Russian LGBT Network” insist that the Ismail Isaev’s term of detention expired weeks before the decision on his arrest.

The “Caucasian Knot” has reported that in early February, law enforcers took from Nizhny Novgorod to Chechnya two natives of the republic, 20-year-old Salekh Magamadov and his brother Ismail, who was then a minor. On February 9, in Urus-Martan, in the absence of advocates and parents, a court sent both brothers under arrest for two months. On April 5, in Chechnya, a court extended their arrest until May 7, and the defence appealed against the court’s decision.

The Supreme Court (SC) of Chechnya has upheld the decision pronounced by the Staropromyslovsky District Court of Grozny on April 5, although earlier, on March 21, the Chechen SC cancelled the pre-trial restriction measure for Ismail Isaev, the “Russian LGBT Network” points out. During the hearing of the Supreme Court of Chechnya, the advocates noted that the decision, under which the Staropromyslovsky District Court of Grozny extended the arrest of Ismail Isaev, had already been cancelled. The defenders also pointed to gross violations of the norms of the procedural law.

“It is extremely strange that those decisions were made despite the fact that the defence paid the attention of the courts to those significant violations,” said advocate Mark Alekseev as quoted by the “Meduza” today.
