Court postpones eviction of large family from their home in Nartan

The Court of Cassation decided not to evict the family of Khamid Indreev pending consideration of his complaint. The challenged decision of the first instance court violates the rights of minor children, who cannot be evicted from their only home, notes lawyer Fatima Kardanova.

The "Caucasian Knot" has reported that by a court decision, Khamid Indreev, a resident of the village of Nartan in the Chegem District, and his nine family members are to be evicted from their home. The Chegem District Court ruled to evict the Khamid Indreev's family and granted a lawsuit filed by a niece of Khamid Indreev, who registered her right to inheritance. The head of the Indreev family lodged an appeal against the court decision. Khamid Indreev suggests the lawsuit was based on forged documents, and an appropriate complaint was filed to the police.

Today, Fatima Kardanova, a lawyer representing the interests of Khamid Indreev, has told the "Caucasian Knot" correspondent that the Fifth Court of Cassation in Pyatigorsk ruled to suspend the eviction of the Khamid Indreev's family pending consideration of the cassation appeal.

Officials from the Guardianship Department for the Chegem District say that until now, they were not aware of the situation with the eviction of minor children. "The court did not involve us in the case. Now we are considering the issue of interference in the situation," the "Caucasian Knot" correspondent was told by Marita Guzeeva, the chief of the Guardianship Department for the Chegem District.

In this case, the rights of children who are deprived of their only housing are violated, lawyer Fatima Kardanova emphasizes. "Minor children cannot be thrown out on the street. This is the first problem. The second problem is that the guardianship institution was not involved in the process. Moreover, the third problem is that two minor children are not mentioned either in the court decision or in the law enforcement proceedings, as if they do not live in the house. The court ruled to evict the parents, and there is no such decision regarding two minor children. The question is, with whom they will stay there," the lawyer notes. Furthermore, Fatima Kardanova adds that no eviction is acceptable during the pandemic.
