Azerbaijani advocate Yalchin Imanov reports violations during consideration of his case

The Azerbaijani Bar Association seeks to deprive lawyer Yalchin Imanov of his authority. The lawsuit will be considered by two courts at once. Yalchin Imanov treats the incident as one of the violations committed by the courts in his dispute with the Azerbaijani Bar Association.

The "Caucasian Knot" has reported that on November 20, 2017, the Presidium of the Azerbaijani Bar Association suspended the authority of advocate Yalchin Imanov. He filed a lawsuit against the Azerbaijani Bar Association, but the court refused to consider it.

"My case shows the absurdity of the Azerbaijani justice. The Ganja Court accepted a lawsuit against me for consideration and explained that I was registered in the Agdam District (which belonged to the jurisdiction of the Ganja Court, note of the 'Caucasian Knot'). And the Baku court used another principle for consideration the place of my actual residence," said the advocate.

There is an incident when two different courts will consider the same case, notes Yalchin Imanov. Meanwhile, violations increase his chances of winning a case at the European Court of Human Rights (ECtHR), to which the advocate intends to appeal.

The consideration of the same issue in different courts is illegal, notes Elchin Mamed, the head of the NGO "Legal Education of Sumgait Youth".

Yalchin Imanov is being persecuted due to the honest fulfilment of his professional duties, believes Elshan Gasanov, the head of the Centre for Monitoring Political Prisoners.

"Yalchin Imanov is one of the most courageous advocates. He was not afraid to defend political prisoners. The reason for his punishment in making public the fact of torture used against religious activist Abbas Guseinov," said the rights defender.
