In Sochi, family with three children asks to reconsider court's decision on their eviction

Tatiana Dyakova and Fyodor Dyakov have filed to the court an appeal with a request to review the decision about their eviction to the street from the municipal building because of the newly discovered circumstances. After the court had pronounced the decision on their eviction, they gave birth to their third child, and another child was recognized disabled. The Dyakov spouses believe the court should take into account the new circumstances.

The "Caucasian Knot" has reported that on March 13, 2015, at the lawsuit filed by the Mayor's Office, the Sochi court decided to evict the Dyakov family with children from an apartment in the manoeuvrable housing fund. The Dyakov spouses twice appealed to City Mayor Anatoly Pakhomov with a request to enter into a settlement agreement and to provide them with social housing. However, they did not achieve a positive solution of their problem. In July, the court refused the Dyakov family in postponement of execution of the eviction decision.

The Dyakov spouses hope that they will be allowed to stay in a municipal apartment or will be provided with alternative accommodation in accordance with the social norms.

"The fact that the status of the family has changed to a family with many children and a family raising a disabled child give them the right to certain privileges," noted advocate Roman Klykov, while commenting on the situation.

According to the advocate, taking into account the new circumstances, the court may reconsider its decision in favour of the family with many children, raising a disabled child.
