Defence treats protocols in Baichorov's case as unreliable

Part of the protocols in the case of Kurman-Ali Baichorov, an Imam of Kislovodsk, accused of illegal drug dealing, contained false information, the defence of the Imam has stated and asked to exclude them from the indictment. The court has held to check the evidence that were put by the first instance court into the basis of the sentence.

The "Caucasian Knot" has reported that on September 23, the Stavropol Territorial Court began considering the Imam's appeal complaint.

The defence has filed a motion demanding to return the case to the prosecutor's office in connection with violations of the Code of Criminal Procedure, since, according to the defence, one of the advocates could not get acquainted with the case files. Also, the defence has stated that the case was investigated by the improper investigating body.

According to the advocate Alaudi Musaev, it is necessary to fill in the gaps of the preliminary investigation.

The defence has also lodged a petition to hold a check of the evidence put into the basis of the sentence. The prosecutor has noted that there is no need to re-examine the evidence.

The defence has stated that a protocol compiled with violations and containing inaccurate information cannot form the basis of the indictment and asked to exclude it from the evidence base. The prosecutor has objected, stating that the protocol is fully compliant with the law.
