Public activists report on problems with execution of ECtHR's judgments in Azerbaijan

The Azerbaijani government fails to comply with its obligations in the field of human rights, and there are serious problems with the execution of the judgments of the European Court of Human Rights (ECtHR) in Azerbaijan. This was stated by participants of the forum "The role and place of international courts in the legal system of Azerbaijan."

The Forum, organized by the public association "Civil Society Platform"'(CSP), was held at the Baku International Press Centre on April 27. It was attended by members of Azerbaijani NGOs, staff members of the Ombudsman's Office, as well as diplomatic officials from embassies of Western states.

While pointing to the problems with the execution of the ECtHR's judgments in Azerbaijan, Alesker Mamedli, a member of the CSP and an expert in law, has expressed his concern about the legislative initiative, which allows the authorities not to execute the verdicts of the Strasbourg Court in the cases of "their contradiction to the Constitution of Azerbaijan."

"The submission of this draft law to the plenary session of the Parliament means that the National Assembly exceeds its powers. The Constitutional laws relating to human rights and freedoms should be adopted through a referendum. This draft law contradicts the Constitution and the European Convention of Human Rights," Alesker Mamedli has said.

Khalid Bagirov, an activist of the civil society and an expert in law, has reported that till present, the ECtHR pronounced more than 110 decisions on Azerbaijan. According to Khalid Bagirov, in terms of monetary compensation, the verdicts of the Strasbourg Court are generally executed.

"However, the measures prescribed by the ECtHR to eliminate the violations revealed by the Strasbourg Court are not taken in practice. The same violations are still committed, and they infringe the legitimate rights and interests of other citizens," Khalid Bagirov has noted.
