In Sochi, woman asks court marshals not to evict her minor children of their only housing

In Sochi, court marshals have arrested an apartment in a house in Pasechnaya Street, in which two minor children live, in order to collect a debt of the former husband of the owner of the apartment.

The "Caucasian Knot" correspondent has been told by Vyacheslav Gabaraev, Deputy Chief of the Sochi Inter-District Department of the Department for the Krasnodar Territory of the Russian Federal Court Marshal Service (known as FSSP), that he as an official is obliged to execute the decision of the regional court, which pronounced the decision with regard to a debt in the amount of 1,578,787 roubles of the woman's former husband, now living in the Moscow Region.

Vyacheslav Gabaraev has explained that in case if the woman "pays out the debt of her former husband, she will thus buy one fourth portion of the apartment, which is treated as the property commonly acquired with her former husband and thus the problem will be solved." The official has added that he has "no claims to the former wife of the debtor."

According to Vyacheslav Gabaraev, the woman should challenge the court's decision if she wants to remove the arrest from the apartment. However, the woman says that she is not able to challenge the court's decision, since she was not a party in the case and no one involved her in the case as a party.

The woman, living in Sochi, says that she has no money to pay out the debt of her former husband, which he made without informing her yet in 2011. According to the woman, in 2013, an official divorce was registered, and since then she did not keep any contact with her former husband. She learned about the debt of her former husband from the court marshals.
