Judgement to return land plot to Sochi pensioner Dubovaya unenforced for over a year

The case of Nina Dubovaya, upon the consideration of which the District Court ruled to return the land plot belonging to her, has been transferred to the Presidium of the Territorial Court. The fact that it has been claimed for the Territorial Court, is no reason for non-issuance of an execution writ within the statutory period of time, believes the advocate Mikhail Okhrimenko.

The "Caucasian Knot" has reported that Nina Dubovaya, the owner of the land plot in question in Poltavskaya Street, lost her property, after the plot received several cadastral numbers. The construction of a high-rise building was launched in the land plot. The Mayoralty filed a claim for recognition of the construction illegal. After several appeals, on March 18, 2015, the Tsentralny District Court of Sochi granted the Dubvovaya's petition and returned the land plot to her. The Krasnodar Territorial Court has legalized the house located in the land plot.

Nina Dubovaya has noted that the court's decision came into force on July 2, 2015.

The case was reclaimed by the complaint of a person, who was not a party to the trial. The complaint stated that the rights of that person were affected by the judgement of the district court, the "Caucasian Knot" correspondent was told at the press service of the Krasnodar Territorial Court.

The press-service has explained that the case is now at the Presidium of the Territorial Court.

The failure to enforce the judgement that has entered its legal force is a violation of the applicant's rights, says a Sochi advocate Mikhail Okhrimenko. The fact that the case was requested by the Territorial Court is no reason for non-issuance of the execution writ on due time, he said.
