Brinikh appeals against refusal to find wiretapping illegal

The ecologist Valery Brinikh has submitted a cassation complaint against the permit to tap his telephone calls examine his email massages.

The "Caucasian Knot" has reported that on December 14, 2015, Valery Brinikh applied to the Investigating Department (ID) for Adygea of the Investigating Committee of the Russian Federation (ICRF) and the Prosecutor's Office demanding to prosecute the law enforcers for the actions that led to the court judgement on wiretapping and examination of his personal correspondence. On December 16, Brinikh appealed against the decision of the Supreme Court (SC); however, on December 24, 2015, the SC refused to consider his complaint.

On December 17, 2014, the court found the article "Silence of the Lambs" by Valery Brinikh an extremist material. The article dealt with the problem of environmental pollution by a pig-breeding complex in Adygea. On November 16 he was charged with extremism committed in a group of persons.

In his complaint to the Presidium of the Supreme Court of Adygea, Brinikh points to the unjustified refusal of the SC to consider his complaint.

The advocate Alexander Popkov has expressed doubt that the complaint will be taken for consideration. However, he noted that it is necessary to pass through all the levels of national courts prior to appealing to the European Court of Human Rights (ECtHR).

The advocate has added that Brinikh's position is strengthened by the time that elapsed since the above judgement, which had not confirm the power agents' fears. At the same time, he noted that this fact has no legal force.
