Verdict to Chechen resident Asrudi Musaev challenged at ECtHR
The court in Chechnya has violated the right of Asrudi Musaev, a resident of Chechnya, convicted for complicity in the fraud with maternal capital, to a fair trial, his defence asserts. A complaint about the verdict has been sent to the European Court of Human Rights (ECtHR).
The "Caucasian Knot" has reported that on December 23, 2014, Musaev was sentenced to 1.5 years in a general security colony and fined by 30,000 roubles. According to the indictment, he had helped Serbieva, a resident of Chechnya, who has been declared wanted for a fraud in the amount of 17,950,227 roubles. According to the defence, Musaev, then engaged as a private taxi driver, was unaware of criminal actions. The defence appealed against the verdict, but Russian courts upheld it.
The complaint sent to the ECtHR by the advocate Mussa Madeev says that during the consideration of Musaev's case, the court violated his rights to a fair trial and effective remedy guaranteed by Articles 6 and 13 of the European Convention on Human Rights (ECHR).
"As a result of illegal actions, Musaev and his family (his wife and five young children) have suffered an irreparable moral harm and material damage, estimated at 50,000 euros," says the complaint.
Let us remind you that Musaev's defence stated that the documents in his case had been falsified and contained factual errors, while witnesses en masse refused from their earlier testimonies.
