Defence of Kislovodsk Imam challenges court's decision on legality of actions of IVS Chief
The defence of Kislovodsk Imam Kurman-Ali Baichorov has repeatedly challenged the decision of the Predgorny District Court, which recognized legitimate the actions of Pominov, the Chief of the IVS (detention facility) of the Predgorny District.
The "Caucasian Knot" has reported that on January 12, Kurman-Ali Baichorov was sentenced to 3.5 years of imprisonment in a common-security penal colony and a fine of 50,000 roubles on charges of drug trafficking. The defence has appealed against the sentence.
On March 5, the court of appeal announced the decision in respect of the actions of Pominov, the Chief of the IVS of the Predgorny District, who sent the Baichorov's complaint about the actions of Judge Oleg Popov to unauthorized person. The court of appeal recognized the Pominov's actions as illegitimate and directed the complaint for new consideration by different panel of judges. Kurman-Ali Baichorov and his advocates appealed to the Predgorny District Court against the Pominov's actions.
According to the Court, the direction of Kurman-Ali Baichorov's complaint "to the investigating authority different from the indicated recipient complies with all the above orders," and therefore, "no violation of law and Baichorov's rights have been found in the Pominov's actions."
The defence indicates that one of the orders issued by the Ministry of Internal Affairs (MIA), to which the Court refers, has not been in force before November 25, 2014, and thus, "the Court has referred to the regulation, which was not valid at the moment of the action challenged by the complaint."
