Trial on death of Rajab Magomedov is protracted, says the advocate of suffered party

The defence of Saipula Shamkhalov, accused of inflicting a mortal wound to Rajab Magomedov, is protracting the litigation, said Mansur Sepikhanov, the advocate for the suffered party.

The "Caucasian Knot" has reported, referring to investigators, that on March 27, 2007, Saipula Shamkhalov, a resident of Kizilyurt, during the fight stabbed Rajab Magomedov, who later died from loss of blood. The proof of Shamkhalov’s guilt was based on the testimony of the wwife of the deceased, who also argued that some Shamkhalov’s relative was an accomplice, but managed to escape criminal prosecution.

The last court session on the case was held on October 17. According to Mansur Sepihanov, the trial is protracted by the defendant’s advocate, whose motions are all satisfied by the judge.

The judge has also appointed an examination on the motion of the defence "under two certificates from one doctor, which are certified by different signatures," said the lawyer.

At the next session, the defence of the suffered party will challenge the judge, said the advocate.

Let us remind you that Saipula Shamkhalov was detained in June 2014, although in 2011 the case of Magomedov’s death of was sent to the court. In March 2013, at the request of the wife of the deceased, the case was returned to the Prosecutor's Office to eliminate the procedural errors and to prosecute the investigator, who had admitted, in the opinion of the suffered party, fabrication of case materials.
