The court in Dagestan refused to acknowledge violations in the case of a kidnapped policeman

Sovietsky district court of Makhachkala dismissed a motion of lawyer Konstantin Mudunov who demanded to acknowledge the investigator’s inaction on the case of kidnapping policeman Alihan Nurukhalaev unlawful. However, the lawyer said that he was satisfied with the results of his claim to court and was not going to appeal against the judgment.

Earlier, the “Caucasian Knot” reported that officer of the First regiment of patrol and inspection service of Department of Interior Affairs of the Russian Federation in Makhachkala Alihan Nurukhalaev disappeared on October, 17, 2012. Lawyer Konstantin Mudunov who represented the interests of his mother Patimat Magomedova demanded to acknowledge her sufferer and interrogate her with his participation.

A criminal case on the “fact of Nurukhalaev’s obscure disappearance” was initiated according to clause 105 (murder) of the Criminal Code of the Russian Federation but Alihan Nurukhalaev’s mother disagreed with the formula “obscure disappearance” insisting that her son was kidnapped.

“But we achieved our goals, anyhow. Almost all our demands were granted. Public Prosecutor promised to provide me with copies of all the necessary materials within two days. We will only have to interrogate the sufferer with my participation. The investigation will not be able to cover up the fact that Nurukhalaev was kidnapped by members of the top brass”, Konstantin Mudunov said to the “Caucasian Knot”.

The case of Nurukhalaev’s abduction was held up till March, 6, because of impossibility to establish identity of the persons involved in the crime, however Asad Abakarov told the “Caucasian Knot” that the resolution of holding up the case would be cancelled in the nearest future.
