The Supreme Court of Dagestan took over a claim of lawyer Kadiev who appealed against the law of cancellation of direct election of Head of the republic

The Supreme Court of Dagestan took over the claim of lawyer Rasul Kadiev who appeals against the amendments to the Constitution of the republic cancelling direct election of Head of the region. The President and the Parliament of the republic were suggested to provide evidence of observation of the procedure during adoption of the disputable law until June, 18.

It should be reminded that on April, 18, the deputies of People’s Assembly of Dagestan adopted amendments to the Constitution according to which Head of the region would be elected by the deputies of the republican Parliament, not the national election as the legislation stipulated before.

Earlier, the “Caucasian Knot” reported that on May, 7, Kadiev submitted a statement to the Chancery of the Supreme Court with the request to acknowledge the republican law “On enacting amendments to the Constitution of the Republic of Dagestan” inoperative. The motion of acceptance of Kadiev’s claim was dismissed.

The Supreme Court refused to take over Kadiev’s claim based on point 1, part 1, clause 134 of the Code of Civil Procedure, Head of Press Service of the Supreme Court of the republic Zarema Mamaeva explained.

According to the Code, the court can dismiss taking over a claim, in particular, in cases when it is not liable to consideration within civil trial or the statement “appeals against acts not touching upon the claimant’s rights, freedoms or legal interests”.

Hearing of the case is appointed at 14:30, June, 21, 2013.
