Rasul Mirzaev not to demand compensation for excessively served term

The defence of Rasul Mirzaev will not challenge the decision of the court, which found him guilty of causing by negligence the death of Ivan Agafonov, and will not seek compensation for the excessive length of stay in detention. This was announced by Alexei Grebenskoy, the lawyer of Rasul Mirzaev.

On August 13, 2011, in Moscow, the conflict between Rasul Mirzaev and Ivan Agafonov occurred. Rasul Mirzaev hit the Moscow resident, and the latter was hospitalized and died on August 18, 2011. On November 15, the court session on the case announced the results of new examination, which did not reveal a direct relationship between the blow of the athlete and the death of Ivan Agafonov.

Today, the court found Rasul Mirzaev, a native of Dagestan, guilty of causing by negligence the death of Ivan Agafonov and sentenced him to two year of imprisonment. Given the fact that Rasul Mirzaev has been under arrest since August 2011, the court counted his sentence at the ratio of two days of imprisonment for a day of preliminary detention.

Rasul Mirzaev himself was released from a "cell" in the courtroom, and after that, he left the courtroom, accompanied by bailiffs. Journalists waited for the athlete at all entrances to the court; however, even after nearly two hours after the verdict had been announced and the athlete had been released, he did not go out to the journalists, and many of them suspected that the court staff assisted in his leaving the building through a "back entrance".

According to sources at the law enforcement agencies, Rasul Mirzaev left the court building in a police paddy wagon, which drove out of the yard of the Zamoskvorechye Court, the RIA "Novosti" reports. "Rasul Mirzaev was given his documents and released," a staff member of the Court said.

The "Caucasian Knot" also reported that the parents of Ivan Agafonov called the court decision with regard to Rasul Mirzaev unlawful and declared their intentions to appeal against the verdict.
