Figurant in Politkovskaya's murder case is against Pavlyuchenkov's deal with justice

Sergey Khadjikurbanov, former staff member of the Ministry of Internal Affairs (MIA), accused of the organization of journalist Anna Politkovskaya's murder, asks to terminate the agreement, which was concluded with investigators by Dmitry Pavlyuchenkov, ex-Chief of the Secret Department of the Chief Department of the Internal Affairs of Moscow.

Today, lawyer of the defendant filed to the Investigatory Committee of the Russian Federation (ICRF) a motion to terminate the agreement with the investigators in connection with the Dmitry Pavlyuchenkov's failure to fulfil the conditions of the agreement. This was reported by Alexei Mikhalchik, the lawyer of Sergey Khadjikurbanov.

Alexei Mikhalchik has stated that, in accordance with the law, the defence can not directly influence the investigators' decision to terminate the agreement. However, Alexei Mikhalchik has emphasized that he, being the lawyer, has the right to file any motion on behalf of the defendant.

In particular, in the filed motion, the lawyer points out the contradictions in the Dmitry Pavlyuchenkov's testimony regarding the participation of Sergey Khadjikurbanov, which, furthermore, "are not confirmed by the actual circumstances of the case." Alexei Mikhalchik believes that there is a serious gap in the law regarding the fact that "a person can defame another person, and court in consideration of a case in a particular order does not check those false allegations." "We fear of unfair sentence," the "RAPSI" (Russian Agency of Legal and Judicial Information) quotes Alexei Mikhalchik as saying.

On October 10, the investigator of the Investigatory Committee filed charges in the final version against Sergey Khadjikurbanov under Paragraphs "b", "g", "h" of Part 2 of Article 105 and Article 222 of the Criminal Code (murder of a person in connection with his or her official duties or performance of public duty, committed by an organized grouping by order, and arms traffic). Alexei Mikhalchik has noted that his client had refused to give explanations and claimed his innocence. According to Sergei Khadjikurbanov, Dmitry Pavlyuchenkov defamed him, the "Kommersant" reports.
