Lawyers in Dagestan demand to acknowledge criminal prosecution of resident of Khasavuyrt Magomedov who was shot down unlawful

Attorneys of Zaurbek Magomedov killed near a mosque in Khasavyurt on August, 16, appealed to Khasavyurt city court asking to acknowledge criminal proceedings against the deceased unlawful. The claim has not yet been considered.

It should be reminded that on August, 16, members of power ministries attempted to detain those suspected of murder of Head of Khasavyurt district Alimsoltan Alhamatov. Suspect Gelani Saiapov was detained in his own house and carried to Moscow where an official charge was brought against him. According to the data of the Ministry of Interior Affairs, Zaurbek Magomedov born in 1984, native of the settlement of Ichichali, Khasavyurt district, was a suspect on the same case. During an attempt of detention, he opened fire at law enforcement officers and was killed by backfire, the Ministry reported.

Zaurbek Magomedov's relatives and attorneys state that at the moment of detention he put up no resistance and was just shot down.

On September, 16, lawyers Adilgerey Omarov and Ruslan Omarov appealed against the resolution of starting criminal proceedings against Zaurbek Magomedov in Khasavyurt city court. In their appeal the lawyers ask to acknowledge the resolution of initiating a criminal case according to clause 317 of the Criminal Code of the Russian Federation against Magomedov unlawful and unjustified, lawyer Ruslan Omarov told the "Caucasian Knot" correspondent.

The attorneys base their arguments on video records of security cameras established in the mosque near which Zaurbek Magomedov was killed.

According to the killed man's brother Taribek Magomedmirzaev, he submitted a statement to T. Sutaev, Head of Committee of Inquiry of the Russian Federation (CIR) in Dagestan, asking to start criminal proceedings according to part 2, clause 105 (murder) against the persons who killed Zaurbek Magomedov. Taribek Magomedmirzaev states that the use of arms against his brother by special services was illegal and unjustified.

Taribek Magomedmirzaev also demands from investigative bodies to stop criminal prosecution concerning Zaurbek Magomedov for lack of corpus delicti in his actions.

He reported new circumstances on the case unknown earlier: "by the moment of murder Zaurbek Magomedov had about 500 thousand rubles with him".

In his statement to Head of CIR in the Republic of Dagestan, Khasavyurt, Taribek Magomedmirzaev writes that the video cameras clearly show that when Magomedov was encircled he dropped his bag and ran away. The personnel picked up the bag and threw it into their "Gazel" car. Later the bag turned out to be with the investigator but no money was found in it.

In his statement Taribek Magomedmirzaev also asked to acknowledge him aggrieved person and civil claimant for most of the money was meant for paying wages to the workers of the organization where Magomedmirzaev worked.

Is should be mentioned that by the moment of murder Magomedov worked as a security guard in private security firm "Dagestan" limited company.

Investigative Department of the Republic of Dagestan in Khasavyurt provided no comment on investigation of the case.
