In Sochi, court marshals evict family of 12 persons to street

In Sochi, tenants of the building No. 23 in Jan Fabricius Street claim violation of their rights and attempts of using force, committed by court marshals to evict them from the house they own because of plans to build the Olympic facilities.

On August 22, court marshal Sergey Kharlanov handed to residents of the building No. 23 in Jan Fabricius Street the decision on initiation of enforcement proceedings, in accordance to which the tenants were obliged to release the house and the land plot within one day. This was reported by Evgeny Mzokov, a resident of the house.

According him, 12 persons, including 4 minor children, live in the house; no housing are to be provided to them in return, and they have no opportunity to challenge the decision of the court, since Sergey Kharlanov visited them with power agents and demanded immediate eviction.

"The children were crying. They were frightened, and their parents fell ill with heart attacks. Power agents wanted to beat me. I jumped to the house in time and barricaded the door. While court marshals were knocking and walking through our yard, I called my friends and asked them to urgently come to record the arbitrariness. Several minutes later, our friends approached our house," the source told the "Caucasian Knot" correspondent.

"Only after that, the court marshals began to behave normally. I went out and asked them to provide me with time, required by the law to appeal against the decision of the court marshal and the court of August 21, 2012, which they did not even handed out to me," Evgeny Mzokov said.

In his turn, the court marshal Sergey Kharlanov has rejected accusations of unlawfulness of his actions and attempt to beat Evgeny Mzokov for his refusal to leave the building.

"On the contrary, I understand that the family has minor children, and I gave about 10 days to solve the problem of relocation," Sergey Kharlanov said.
