Dagestani Supreme Court dismisses motion of relatives of boy, killed in explosion

Today, the judicial panel of the Supreme Court of Dagestan dismissed the appeal of relatives of an 8-year-old Gadji Nasrutdinov, who died in the hospital as a result of a double explosion in Makhachkala on January 28, 2012. The relatives of the deceased child demand to qualify the explosion as a terror act.

The relatives of Gadji Nasrutdinov tried to challenge the second decision of the Soviet District Court of Makhachkala.

On January 28, in Makhachkala, an explosive devise detonated near the house No. 12 in Shamil Avenue. When police officers arrived at the scene, the second explosion occurred in a garbage can near the cordon. As a result of explosions, two children were injured Gadji Nasrutdinov and a 12-year-old Timur Bagalov. On February 2, Gadji Nasrudinov died at the hospital.

Criminal case was initiated under four Article of the Criminal Code of the Russian Federation: "grievous bodily harm", "illegal possession of weapons", "disorderly conduct", "illegal manufacture of arms"; however, the relatives of Gadji Nasrutdinov did not agree with the versions as the investigators classified the explosion.

Abakar Nasrutdinov, a brother of the deceased boy, told the "Caucasian Knot" correspondent that they demand to qualify the double explosion as a terror act and that earlier they filed such a complaint to the Soviet District Court of Makhachkala. However, judge then ruled that he was not authorized to impact the investigators.

That decision was challenged at the Supreme Court of Dagestan, and the judicial panel returned the case for a new consideration; however, the judge of the Soviet District Court made for the second time a decision not in favour of the Nasrutdinov family.
