In Dagestan, policemen accused of beating teenager are in prisoner's dock

The Prosecutor of the Khunzakh District of Dagestan has approved an indictment against two employees of the Shamil ROVD (District Interior Division) Shamil Magomedaliev and Gamzat Nurudinov, accused of beating a teenager. Today, the case was transferred to the Khunzakh District Court.

The case against Magomed Magomedov was isolated into a separate proceeding; and on July 12, the court sentenced him to three years in prison; however, the decision has not yet entered into force. On July 17, the defendant's lawyer appealed against the sentence.

Later, the charges were dropped from the driver Aliaskhab Nurichuev; the investigation has not found any sufficient evidences of his guilt, explained the prosecutor Zapir Magomedov.

"The victim said that the driver had struck him, but he did not specify when or how it happened; and during the confrontation, he did not point at the driver. After reading the first indictment, I returned it to investigators and recommended to clarify the point: if the driver was involved in the beating, then it was necessary to figure out the details, if not - not to present charges against him. They chose the second option," said Zapir Magomedov.

Aliaskhab Nurichuev has passed into the category of witnesses; however, at the first trial in spring of 2011, he did not testify against his colleagues. He said that the teenager and the district policeman sat on the rear seat, while he was driving the car and saw nothing, since the dangerous mountain road took up all his attention.

The second investigation against Shamil Magomedaliev and Gamzat Nurudinov was completed in late June; and in early July the five-volume case arrived for approval in the Khunzakh Prosecutor's Office. According to Prosecutor Zapir Magomedov, he had no objections to the work of investigators.
