Ex-Prosecutor of Rostov Region appeals to ECtHR

Valery Kuznetsov, ex-Prosecutor of the Rostov Region, who seeks reinstatement in office, filed a complaint to the European Court of Human Rights (ECtHR) against the District Court's refusal to consider the case in the Rostov Region rather than in Moscow.

On April 10, Valery Kuznetsov filed a complaint to the Court of the Leninsky District of Rostov-on-Don on reinstatement in office; however, on April 16, the Court returned the complaint in connection with "the immunity of the dispute." The judge considered that the principal defendant was not the Rostov Regional Prosecutor's Office, but the General Prosecutor's Office. Valery Kuznetsov appealed to the Rostov Regional Court, which on May 21 refused to return the complaint of the former Prosecutor to the District Court of Rostov-on-Don.

"Valery Alexeevich appealed to the ECtHR with the complaint of violation of his rights under the European Convention and its protocols, in particular, the right to judicial protection," stated Nikolai Gorbal, the representative of Valery Kuznetsov.

He has explained that a citizen has the right to seek remedies at any court of those that are prescribed by the law. Besides, Valery Kuznetsov filed to the Strasbourg ECtHR his claims for compensation for moral damage. Nikolai Gorbal refused to comment on its amount. Besides, according to him, he has already filed a complaint to the Presidium of the Rostov Regional Court.
