Dagestani Minister of Industry fined for violating antimonopoly legislation

The Soviet Court of Makhachkala decided to inflict penalty against Magomedgusen Nasrutdinov, Minister of Industry, Energy and Communications of Dagestan, in the form of a fine amounted to 12,000 roubles for failure to fulfil the order of the Dagestani Department of the Federal Antimonopoly Service (FAS) of Russia.

The "Caucasian Knot" correspondent was told by an officer from the Dagestani Office of the Federal Antimonopoly Service (FAS), the FAS Department was addressed by representatives of two companies Limited Liability Company (LLC) "NTC Soliton" and LLC "Rosnek", the authorized gas distribution organizations for supply of liquefied gas for domestic using.

The companies complained of violation of the antimonopoly legislation, committed by the Ministry of Industry, Energy and Communications of Dagestan, where, according to the complainants, fuel, intended for supply to domestic using of the population, was illegally redistributed. In that case, according to the complainants, the preference was given to one organization (LLC "Dag-S-Gas").

In the course of consideration of the case, the FAS Department has admitted that the Ministry of Industry, Energy and Communications of Dagestan had violated Part 1 of Article 15 of the Federal Law No. 135 "On Protection of Competition" and issued to the Ministry an order to restore the violated rights of the companies.

The Ministry challenged the decision at the Court of Arbitration of Dagestan; however, the Court dismissed the appeal. The Sixteenth Arbitration Court of Appeal also upheld the decision made by the FAS Department. The cassation instance, namely, the Federal Arbitration Court of the North-Caucasian Federal District (NCFD), also dismissed the appeal. Minister Magomedgusen Nasrutdinov was punished by a fine for failure to fulfil the FASD prescription.
