Public prosecutor's office in Nalchik detected abuse of authority by an official of Mayor's office

Public prosecutor's office of Nalchik detected a fact of abuse of authority by an official of Nalchik municipal Administration, i.e. Head of the Department of Communal services and utilities, the supervisory office reports.

Representatives of Public prosecutor's office state that during the tender on overhaul of Lenin prospect in Nalchik the official took illegal measures for "Dorremontstroy-1" limited corporation constitutor and general director of which his son was to receive the order. Participant of the tender "Nalchik Construction Administration" limited corporation whose application was rejected submitted a complaint concerning this fact.

According to Deputy Public prosecutor of Nalchik Alexey Vovk, in process of inspection of the circumstances of holding the tender it was established that Head of the Department sanctioned the requirements specification for the tender with deliberately perverted information about the parameters of the services required.

"In particular, the application to the requirements specification "Street lighting" included a model of lamp with non-existent features: the height of the lamp, light transmission and others, Alexey Vovk explained. - Trade name Philips in the section "Lamp" was deliberately substituted for Phyilips".

During initial consideration of the applications all of them were rejected. On December, 14, 2011, General Director of "Dorremontstroy-1" limited corporation appealed to the Department of Federal Antimonopoly Service (FAS) of Russia in KBR complaining of the actions of Committee of the Department for municipal custom of local Administration of Nalchik. Deputy Head of the Department of FAS of the Russian Federation in KBR issued an order for integrated Committee of the Department for municipal custom according to which only "Dorremontstroy-1" limited corporation was allowed participation in the above mentioned tender, Public prosecutor's office reports.

According to the office, as a result of these illegal actions in accordance with Protocol No 3, 30.12.2011, "Dorremontstroy-1" limited corporation was acknowledged the only participant of the tender and the Department of Communal services and utilities was advised to sign a municipal contract with the corporation on the initial price of 157 040 320 rubles.

Besides, the Department of FAS of Russia in Nalchik issued orders of administrative sanction in form of a fine concerning members of integrated Committee of the Department for municipal custom of Nalchik Administration which resulted in serious violations of the latter's rights, Public prosecutor's office reports.

Materials of inquiry on the fact were referred to Investigative Department of Committee of Inquiry of Russia in KBR upon the results of consideration of which a criminal case on indications to crimes stipulated by part 1, clause 285 of the Criminal Code of Russia (the use of authority by an official despite the interests of service committed out of mercenary or other personal interests resulting in serious violations of the rights and legal interests of citizens or organizations) and part 1, clause 286 (committing actions by an official evidently going beyond the limits of his authority resulting in serious violations of the rights and legal interests of citizens or organizations) a criminal case was initiated against Head of MKU "Department of Communal services and utilities - customer service" of local Administration of Nalchik and Head of Department of FAS of the Russian Federation in KBR.

According to expert estimations, the cost of overhaul work in Lenin prospect was overrated by 37 million rubles.
