The defense will appeal against the sentence to the defendant accused of Dzhaparidze's murder

Alexander Vasiliev, attorney of Yury Tikhomirov acknowledged guilty of murder of anti-fascist Ilya Dzhaparidze and sentenced to ten years of custody in a strict regime colony declared that he would appeal against the verdict of guilty concerning his client as unlawful and unjustified.

Alexander Vasiliev explained the "Caucasian Knot" correspondent that he intended to appeal against the sentence to Tikhomirov in the cassation court and in the supervisory authority against unlawful in his opinion recommitment of the case to Public prosecutor at a very late stage of the process, i.e., the day before debates between the parties in Moscow city court where the case was considered with the participation of the jury.

"During the trial in Moscow city court state prosecution had a right to withdraw part of the charge against Tikhomirov instead of recommitting the case which was only done in order to re-qualify the charge in accordance with a clause disallowing trying by the jury because the reasoning of Tikhomirov's guilt was very ambiguous and the jury could exculpate him", the lawyer considers.

The lawyer said that the court rejected the motive of ethnic hatred which, according to the investigation's version, was the reason for Dzhaparidze's murder.

Alexander Vasiliev also said that three hearings on the case were held in Liublinsky court during which by agreement of the parties the witnesses' evidence was read out but the court summoned none of the witnesses for interrogation.

The journalists were not admitted to the sentencing procedure because the trial was held in a close regime. Dzhaparidze's relatives and Tikhomirov's mother were waiting for the verdict near the courtroom together with representatives the press. The sentencing procedure started with an hour's delay because of a warning of a bomb in the building and evacuation of the people. According to Visiliev, his client listened to the verdict calmly.

Tikhomirov's mother told the "Caucasian Knot" correspondent that she did not believe in her son's guilt. "All the time he lived in Dubna with he. He has always been a nice boy and he did not commit the crime he was accused of", the woman states.
