Defence of Arakcheev, convicted for murdering three Chechen residents, demands his case reconsideration

Defence of Sergey Arakcheev, ex-officer of internal troops of the Ministry of Internal Affairs (MIA), who was sentenced to 15 years of imprisonment in a colony for murdering three Chechen residents in January 2003, asks the General Prosecutor's Office to reopen the case, since new reasons for its reconsideration have appeared.

Let us remind you that on November 10, 2011, lawyers filed a motion for reconsideration of Arakcheev's case. On November 9, 2011, lawyer Dmitry Agranovsky announced his intention to file a complaint to the General Prosecutor's Office and mentioned a "lie detector" test, which proved Arakcheev's innocence, as the basis for his complaint. The Military Prosecutor's Office refused to reconsider the case of Sergey Arakcheev.

The fact that his appeal to the General Prosecutor of the Russian Federation contains a detailed analysis of the "refusal" letter of Beloousov, the head of the Chief Military Prosecutor's Office, was told to the "Caucasian Knot" by Dmitry Agranovsky, the lawyer of the convicted man.

"Beloousov communicates information, which does not correspond to reality and which are not accurate. For example, the letter stated that the actions of Arakcheev had been confirmed by testimony of eyewitnesses; however, the case contains no such materials. Secondly, that the Arakcheev's guilt had been confirmed by his own confession, and the case does not contain such a material. Thirdly, that the bullet shell, not suitable for fire arms of Arakcheev and Khudyakov, was allegedly found not in the place of crime, but somewhere else; however, the examination states that it was found in the place," the defender argued.

According to Dmitry Agranovsky, the "refusal" documents for the resumption of the Arakcheev's case also stated that "there was no reason to trust the testimony of the lie detector, since a long period of time passed." However, according to the lawyer, "that is just an evaluation category, since modern science does not put reliability of tests on lie detector in dependence on time."

Besides, according to the lawyer, the investigation was conducted with violations, since lawyer Abramov appointed to defend Arakcheev presented not his Moscow warrant, but his warrant of the Chechen Bar, and that was strictly prohibited. Besides, according to the lawyer, the court had no right to refuse interrogation and entering medical examinations upon the record in accordance with the Resolution of the Plenum of the Russian Supreme Court issued in 2010.
