ECtHR entered a lawsuit of six persons replaced from Armenia in the reference

On January, 9, the Upper Chamber of European Court of Human Rights (ECtHR) announced its primary decision on the case "Charygov and others vs. Armenia" consideration of which was started upon a lawsuit of six citizens of Azerbaijan replaced from the zone on Nagorno-Karabakh conflict.

Earlier, the "Caucasian Knot" reported that the lawsuit was submitted by residents of Lachi district of Azerbaijan (presently territory of Nagorno-Karabakh), ethnic Kurds Elhan and Adyshirin Charygov, Ramiz Jebraiilov, Akif Gasanov, Fehreddin Pashaev, Garaja Jebraiilov (the latter died, his representative in court is his son Sagatel Jebraiilov). The complaint was submitted to the European Court of Human Rights on April, 6, 2005, and considered at a trial in Strasbourg on September, 15, 2010.

The claimants on the case "Charygov and others vs. Armenia" state that they were driven out of their houses in the town of Lachi in May, 1992, as a result of occupation of Lachi district by Armed Forces of Armenia and cannot return home and get property back up to now.

The claimants also emphasize that the Armenian Government violates their rights and pays them no compensation for their lost property. They demand from the Armenian authorities to let them go back to their motherland and undo the damage to their property in full.

The statement of claim was based upon the clause of European Convention on Human Rights on immunity of property, privacy and the right of fair trial. Violation of the clause of discrimination was also pointed out in the statement. In the plaintiffs' opinion, if they were not Armenians and Christian believers they would not have been banished from their homeland, Vesti.az reports.

Acknowledging the statement of claim grounded the Upper Chamber entered it in the reference. The Court now has to give a final judgment on the case, APA reports.
