Dagestani SC considers rights defender's complaint against head of Republic's IC and General Prosecutor

On December 26, in Makhachkala, the Supreme Court (SC) of Dagestan considered the complaint of the human rights defender Nasrudin Rasulov, the lawyer of the public organization "Fighter for Justice", against Savrulin, the head of the Investigatory Committee in the Republic of Dagestan, and Nazarov, the Republic's Public Prosecutor.

Let us remind you that in 2009, a criminal case was initiated against Nasurdin Rasulov under Part 2 of Article 306 of the Criminal Code of the Russian Federation (intentionally false denunciation). During the entire year, the human rights defender was under investigation. Later, in October 2010, the criminal case was cancelled as unlawful.

"However, the investigators did not suffer any punishment, although their actions fall under specific articles of the Criminal Code," stated the human rights defender in his interview to the "Caucasian Knot" correspondent.

To restore justice and receive compensation for moral damage, Nasrudin Rasulov filed a lawsuit to the court. Earlier, he appealed to the European Court of Human Rights (ECtHR), which accepted his statement to consideration.

"At the Supreme Court, I have challenged the actions of Alexei Savrulin, the head of the IC in the Republic of Dagestan, who failed to take any actions in regard to his subordinate Tagir Sutaev, the head of the Khasavyurt MRSO (Inter-District Investigatory Division). He ignored the complaint about serious crime committed by a police officer. On that occasion, I appealed to Alexei Savrulin as the IC's head in accordance with Article 124 of the Criminal Procedure Code of the Russian Federation, and he failed to do anything. Because of his inaction, I decided to appeal to the court under Article 125 of the Criminal Procedure Code of the Russian Federation to recognize the Alexei Savrulin's actions unlawful," told Nasrudin Rasulov the "Caucasian Knot" correspondent.

Besides, the human rights defender reported that he had challenged the actions of Andrei Nazarov, the Prosecutor of Dagestan. According to the human rights defender, the Prosecutor left his appeal without making a procedural decision. The appeal was written asking to challenge the ruling of Judge Makhatilova from the Soviet Court of Makhachkala.

"The law stipulates: if there is an appeal, there should be a procedural decision in the form of ruling. The Prosecutor Andrei Nazarov failed to complete that," said Nasrudin Rasulov.

The panel of judges of the Supreme Court granted the Nasrudin Rasulov's complaint against Alexei Savrulin. The Court pronounced the decision to return the case to the Khasavyurt court for reconsideration.

The human rights defender's complaint against the Prosecutor was not granted by the Supreme Court. Nasrudin Rasulov has announced that he does not agree with the Court's decision and that he intends to challenge the decision through supervisory procedure at the Supreme Court of the Republic.
