Eduard Kokoity starts forming Constitutional Court of South Ossetia

The incumbent President of South Ossetia Eduard Kokoity, who declared tonight his forthcoming resignation, has appointed two judges of the Constitutional Court, thus starting to form it.

As explained by the parliament of South Ossetia, the outgoing president has filled in his quota of the Constitutional Court, which has not been formed yet, but the provision thereon is stipulated in the Constitution of the Republic of South Ossetia (RSO).

"Two judges are appointed by the president, and two – by the parliament," said the source. "The Chairman of the Constitutional Court is also presented by the president for approval of the parliament."

Today, Mr Kokoity has signed a decree and appointed Gregory Sobaev, an employee of the military prosecutor's office, and Eldar Kokoev, who at the same time was dismissed from the post of Deputy Public Prosecutor, to be the Judges of the Constitutional Court of South Ossetia, the "Osinform" reports.

Since Eduard Kokoity has resigned today, the parliament believes that the Constitutional Court will be formed completely after the election of new president on March 25, 2012, the IA "Res" reports.

The opposition is outraged that the Deputy General Public Prosecutor Eldar Kokoev, whose resignation was written in the agreement between Alla Djioeva, the ex-opposition presidential candidate, and the incumbent head of the republic as a separate item, was appointed a Judge of the Constitutional Court.

"Yesterday we demanded his resignation, and today he is imposed as a member of the Constitutional Court. I am a peace-loving person, and I go to a compromise, but it is a clear violation of the agreement," the "Interfax" quotes Ms Djioeva as saying.
