Armenian citizen captured in Azerbaijan send complaint to ECtHR

Arthur Badalyan, an Armenian citizen, who was captured in Azerbaijan, filed a complaint to the European Court of Human Rights (ECtHR). The complaint concerns the very fact of his capture, inhuman treatment and torture.

Earlier, the "Caucasian Knot" reported that Azerbaijan delivered the Armenian citizen Arthur Badalyan to the Armenian side on March 17.

Arthur Badalyan, resident of the village of Agartsin of Tavush Region, lost himself in the forest and was captured on May 9, 2009. On November 8, 2010, the Azerbaijani side has confirmed the fact of his capture, the "News of Armenia" reports.

"He was subjected to torture and held captive in violation of the human rights and freedoms guaranteed by the Constitution of Azerbaijan and the European Convention on Human Rights. In this regard, we expect that the ECtHR will find a violation of Article 2 of the Convention, that is, prohibition on violence, and Article 5 – inviolability of personal freedom," the website of the radio station "Svoboda" (Freedom) quotes lawyer Edmon Marukyan as saying.

Due to assistance of a public organization, the former prisoner underwent medical treatment in Yerevan. According to preliminary estimates, the patient's mind had been severely damaged, the publication "Times.am" reports.

In turn, the Azerbaijani side asserts that Badalyan was provided with decent living conditions. In particular, it is reported that during the period of his captivity, he was visited by the representatives of the International Committee of the Red Cross (ICRC), the publication "1news.az" reports.
