In Kabardino-Balkaria, despite court's decision, militant's family cannot get his body

The Nalchik City Court held a decision to give out the body of Kazbek Tashuev, the Baksan Jamaat leader, who was killed on April 29, 2011, in the village of Progress of the Stavropol Territory, to his family for the burial. However, the court's decision has not been fulfilled yet.

Asya Tashueva, widow of Kazbek Tashuev, appealed to the court asking to give out her husband's body for the burial. In her application she wrote that her husband Kazbek Tashuev was killed not in the moment of the terror act's prevention, thus, there were no legitimate reasons to hold the body.

In course of the special operation on April 29 10 people were killed. The bodies of seven deceased were given out to their relatives for the burial. Bodies of Asker Djappuev, Kazbek Tashuev and Ratmir Shameeva, whom the investigators treat as militants' leaders, remain at the disposal of the law enforcement agencies.

During the trial, a representative of the investigatory authorities argued against giving out the militant's body. He referred to the fact that Tashuev was suspected of involvement in a number of serious crimes.

The court found the refusal of giving out the bodies illegal and ordered to eliminate violations of the law. Despite this decision, the body was not given out. On July 22 the Nalchik Prosecutor's Office appealed to the Supreme Court of the Kabardino-Balkarian Republic (KBR) with cassation, asking to rule the City Court's decision on giving out the body unlawful and return the case for retrial.

Commenting on the situation with non-giving out the body, Boris Zumakulov, Commissioner for Human Rights in Kabardino-Balkaria, emphasized that he considered it was unfair that some bodies had been granted, and some – had been not. "All should be treated equally."

In accordance with the Law "On burial and the funeral business in the Russian Federation", the terrorists' bodies shall not be given out and the place of their burial shall not be reported.
